Condominium living is unique and puts a great emphasis
on mutual interests, as well as cooperation, consideration and communication
among all residents. To outline what is expected of us, Condo IV’s Board of
Managers has put together this list of guidelines drawn from our Prospectus,
By-Laws and Board minutes. For all residents, unit owners and tenants alike, we
hope this Guide will serve as a readable reminder of the points that will help
all of us maintain the pleasant living in Condo IV and the attractive
appearance of the buildings and grounds. If you have any questions about
whether a rule or regulation applies, please refer to the Declaration
establishing the Condominium and its bylaws. You may also contact a member of
the Board of Managers for clarification.

Each unit is to be used solely as a residence for a single family.

No business is to be conducted from a unit.
-
No activity is to be carried on which may annoy or disturb other residents.

Noise levels are to be controlled.

Visitors are the responsibility of the resident. Please advise your visitors to
park only in designated visitor spots and to walk pet only in designated areas.
-
Unit owners are responsible for maintenance and repair of the inside of their
unit, including painting, windows and doors, as well as maintenance of
appliances. Any repairs to the interior/exterior of the unit must be reported
and approved by the Board prior to commencement of work.

The Condo, through its Board of Managers, maintains and is responsible for: the
outside of the buildings; the buildings’ interior service lines (electricity,
water and sewer); garages and the “common elements” which include all land
areas and roads. No resident may make changes in any of these facilities or use
them contrary to their purpose without advance approval of the Board of
Managers.

As described in the Declaration, all present and future owners and residents of
Condo IV are subject to the provisions of the Declaration, its By-Laws, Rules
and Regulations and policies adopted at Board meetings and published in Board
minutes.

Common charges are assessed to units annually and
payments are due monthly commencing June 1 each year. Common charge payments
are payable to Blackberry Hill Village Condo IV, and may be mailed to The Board
of Managers, 3200 Village Drive, Brewster, NY 10509, or may me dropped in the
Condo IV locked mailbox by the Village Drive circle. Common charge payments are
due on the 1st of each month. If received after 10th of the month, a $20.00
late fee will be assessed to the unit owner’s account.

In the event of an emergency, the Board of Managers or
its agents may need to enter your unit to resolve the problem. In order to
avoid damage to doors, it is required all unit owners supply a key to the board
to allow access to the unit for emergency purposes. Alternatively, you may
leave a key with a family member or neighbor to allow access to your unit in
case of an emergency. You must notify the board who to contact and how to
access the key. In the event that damage does occur as a result of an emergency
entrance because of failure to provide a key or notify the board with key
access information, the unit owner will be responsible for any damages that may
occur as a result of a necessary entry.

Any structural alteration, addition or improvement
inside or any change outside the buildings must be approved by the Board of
Managers, including such items as enlarging, enclosing or covering by awning of
a patio, installation of an attic stairway, attachment of planter boxes to
privacy fences, patios or decks. All floors of a unit having a unit below it
shall always be covered with carpet (except baths and kitchen) to reduce
transmission if impact sound. Unit owners are not to paint, stain or change
color of any exterior portion of any building. No outside satellite dish or
antenna installation is permitted without prior approval from the Board of
Managers. Attic storage in buildings and overhead garage storage must not
include heavy items that may create an overstress on the structure and must not
constitute a fire hazard. Storm doors and windows must be approved by the Board
and, with such approval, must conform to established materials, design and
colors.

Condo IV has been complimented many times by residents
and visitors for its attractive grounds and distinctive appearance. In order to
keep it that way, please abide by the following:

Patios and decks are to be kept clean and in good repair. Toys, bicycles,
wagons, baby carriages, playpens, tents, vehicles, boats, garbage cans, etc.,
are not to be left on walks, lawns or stairwells

No articles are to be hung on outside walls or windows, including signs,
laundry, plastic covers, clothing, blankets, etc. Air conditioner covers are
permitted.

Rugs or mops should not be shaken on or from patios and windows.
-
Replacements for globes and spotlights should be obtained only from the Board
of Managers.

The Condo Association contracts with a professional
landscaper for care of all grounds. While there are two general cleanups -
spring and fall each year - residents are urged to help keep their areas neat
during the growing season by removing weeds and debris. Children should not be
permitted to throw rocks onto the grass or walk areas.
Residents are encouraged to grow plants and flowers
around their units. However, fruits and vegetables are NOT permitted.

Residents are asked to park in their assigned spaces (yellow lines) and leave
the unassigned parking spaces (white lines) open for guests or residents’
additional cars.

Each unit is allowed up to three vehicles on Condo IV grounds (except garages). The vehicles
must be registered with the Board of Managers and bear the Blackberry Hill
Village Condo IV parking sticker, and should have a valid NYS registration and
inspection. Storage of vehicles (with or without valid registration and
inspection) is prohibited and stored vehicles will be subject to towing at the
owner’s expense. If you will be away for an extended period of time, please
notify the Board of Managers so appropriate measures can be arranged

Vehicles should not be parked for more then three days in a row on Visitors Parking Spot.

All vehicles should be parked head-in first. This is to help prevent fumes from
entering units and to protect the landscaping
-
Please observe the designated NO PARKING AREAS, which include fire zones,
hydrants and the circle. Vehicles in violation will be subject to towing and/or
fines
-
Campers, recreational vehicles, busses, boats, trailers, trucks (except capped
pick-up trucks and SUV’s) and commercial vehicles are prohibited, except for
loading and unloading.

A visitor over 4-6 weeks, 5 or more nights per week is considered to be in residence by the Board of Managers and must register any vehicle with the Board.
-
NO washing of vehicles with hoses or buckets is permitted.
-
NO mechanical work on vehicles is permitted.
-
In the event of a snowstorm, residents are required to move their vehicles
within 24 hours to allow proper plowing of the parking lots. Please be alert
and assist by moving your car once plowing starts. If you will be away, please
leave a set of keys with a neighbor who can move your vehicle for you after a
storm.

No flammable, combustible or explosive materials should be kept in any unit or
common area which might create a dangerous condition or which could result in
an increased rate of insurance. Propane grills are prohibited. Natural gas
grills are permitted if professionally installed in accordance with state laws
and local statutes. Approval is needed from the Board of Managers, and the
appropriate forms must be completed and submitted.

Firewood must be stacked one foot away from all wood surfaces and under NO
circumstances should obstruct any stairway or exit. Any damage caused by wood
deliveries will be the responsibility of the unit owner. Coverings for wood
piles should be of a neutral color. No fireplace inserts are to be installed
without prior approval from the Board of Managers.

Annual chimney inspections and cleaning if needed are mandatory and at the unit
owner’s expense. Proof of inspection and cleaning must be submitted to the
Board of Managers by the deadline given in the annual notice.

All thermostats must be set at no lower than 55 degrees from November 1 through
April 1 to avoid freezing of plumbing equipment. In the case of simplex units,
thermostat should be set at no lower than 60 degrees, especially in the foyer
section.

Curtains, draperies, furniture and flammable items should be at least 4 inches
away from all heating elements.

The Condo Association maintains fire insurance on the buildings necessary to
replace the structures in the case of loss, plus necessary liability insurance.
This insurance covers standard carpeting, kitchen cabinets and appliances that
were originally installed as a part of the unit by the sponsor. Residents
should maintain their own fire, theft and liability insurance for the inside of
their unit, including personal property, improvements and loss assessment.

Up to two household pets are allowed per unit provided that they do not create
a nuisance, and AT ALL TIMES must be controlled by their owners.

The grass areas along Village Drive adjacent to 1-84 and behind the fence in
the rear of the 2400-2900 buildings have been designated for walking and
exercising pets. Carry a “pooper scooper” and clean up after your pet at all
times.

All pets, including cats, must be walked on a leash and not allowed to freely
roam the grounds.

Fines will be imposed for violation of the pet rules.

All trash must be in plastic bags before it is placed in the garbage dumpsters.
-
Large items such as carpets, mattresses, appliances, etc., are prohibited from
being placed in garbage dumpsters and sheds. For immediate removal of items not
permitted in regular dumpsters, please call AWS, Advanced Waste Systems at
(800) 921-5568.

The town provides large dumpsters for bulk pick up four times a year. Bulk
service is for household items only. The following items are NOT included for
bulk pick up: Paint, Chemicals, Liquids, Used oil, Stumps, Logs, Trees, Lumber,
Masonry, Brick, Stone, Batteries, Tires, Propane tanks.

Refrigerators, freezers, air conditioners, or any other appliances containing
Freon must be de-charged and tagged by a State authorized specialist. Consult
the Yellow Pages for a professional under “Refrigerator and Freezer-Dealers and
Service”. The carter will not pick up such items without proper certification.

Periodically, the county accepts hazardous waste. Please check the local
newspaper or county website for dates, times and locations.

Co-mingled recyclables, such as glass bottles, aluminum, tin and metal cans,
foil and pie plates, and plastic containers (numbers 1, 2, and 3 as specified
on the containers only) should be rinsed. They can be co-mingled in clear or
blue tinted recycling bags. Recycling bags are available at most local
supermarkets.

Newspapers, magazines and other paper products may be co-mingled and tied with
cord in bundles no higher than 10 inches. Corrugated cardboard must be broken
down, cut, separated and bundled not higher than 10 inches and not wider than
36 inches in either direction, and shall be tied with cord.

Rentals are permitted provided advance notification is given to the Board of
Managers in compliance with Article VIII of the bylaws. It is required that the
Board of Managers be provided with a copy of the lease within 15 business days
once executed by the unit owner and the tenant.

Owners who lease their units are responsible for informing their tenants of the
rules and regulations and for ensuring that they are observed. A copy of this
Guide should be given to the new tenant prior to signing of the lease. In
entering into a lease, a tenant confirms that he/she accepts these provisions,
rules and regulations and will comply with them.

Rules for use of the swimming pools and other recreation areas are set forth by
the Pool Committee. A copy of these rules may be obtained from the Pool
Committee and are posted at the maintenance building near the pool entrance.

If you see any person acting suspiciously in the area or are subjected to, or
witness any acts of vandalism, theft, etc., call the Sheriff’s Department
(225-4300).

In the event of a violation of these rules, the Board of Managers has the right
to impose fines and/or take appropriate legal action.
